Policy on Anti-Terrorism
It is Ayala Foundation USA’s (AF-USA) policy to award grants to organizations exclusively in furtherance of charitable purposes, as defined by the U.S. Internal Revenue Code. Accordingly, AF-USA substantiates the charitable status of each recommended grant recipient.
Ayala Foundation USA (AF-USA) specifically safeguards its operations from terrorist activities by complying with the Uniting and Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism (USA PATRIOT) Act. Compliance to the act in order to prevent non-profit organizations like AF-USA from being used as a front for terrorist activities is of primary concern of the Foundation.
AF-USA has instituted safeguards on two (2) levels to protect the foundation, its donors, and partners:
Donor Level
1) |
All donors are required to accomplish and submit a Donation Form which contains detailed information about the source of the donation; |
2) |
All donors who recommend specific organizations to become AF-USA partners are required to vouch for the legitimacy of the organization; and |
3) |
All donors are required to sign a waiver, granting AF-USA full control of fund disbursement and performance of due diligence tasks. |
Partner Level
1) |
All partners are required to accomplish and submit a Grant Eligibility Application, which clearly specifies that no funds can be used to support terrorist activities; |
2) |
All partners are required to submit organizational documents as proof of the legitimacy of the organizational and the project; |
3) |
All partners give full consent to the AF-USA Board of Trustees to approve or disapprove their application at any point; |
4) |
All partners receiving grants are required to sign a contract indicating that none of the funds will be used to support terrorist activities; |
5) |
All partners receiving grants are required to submit regular reports on the progress of the organization and the project. |
If Ayala Foundation USA is unable to verify the charitable status of an organization or if an organization is suspected of supporting terrorism, Ayala Foundation USA will not approve a grant recommendation to that organization.
In addition to the safeguards instituted in the donor and partner levels, AF-USA is also committed to cooperate with U.S. authorities in terms of:
1) |
Giving full disclosure of its contributors, the amounts of contributions received, and the recipients of funds; |
2) |
Sharing of database information, if so required by U.S. authorities; |
3) |
Providing access to AF-USA project and financial records, if so required by U.S. authorities; and |
4) |
Reporting suspicious contributions and causes supported by donors, if they exist. |
